The Chamber in Contentious Administrative Matters of Tucumán rejected an indemnity claim filed by the family of singer Sergio Denis regarding his 2019 fatal accident at the Teatro Mercedes Sosa. The court ruled that the singer’s own actions—walking backward while performing—constituted a “hecho de la víctima” (act of the victim) or “autopuesta en peligro” (self-endangerment), which severed the causal link necessary to hold the theater, organizers, or the State liable.

Following the ruling, which also ordered the family to cover legal costs, the singer’s daughter, Bárbara Hoffmann, criticized the decision as “lamentable” and accused the justice system of acting with “much impunity.”

In response to the verdict, the family has formally announced their intention to appeal the decision. Bárbara Hoffmann stated that the family is working with legal counsel to challenge the ruling and intends to pursue the claim “to the last consequences.” The appeal aims to overturn the finding of self-endangerment and address concerns regarding the safety conditions and stage maintenance at the theater during the March 11, 2019, incident, which resulted in the singer's death in May 2020.
