Slovakia: Legal guidance on substitute maintenance after pension denial
In Slovakia, legal guidance has been provided regarding financial support for individuals whose applications for an orphan pension have been denied following a parent's death.
According to legal expert Mgr. Miroslava Dobrotková, PhD., if an unsupported child does not qualify for an orphan pension, a surviving parent or authorized person may apply for substitute maintenance through the relevant Office of Labour, Social Affairs and Family. This maintenance is calculated as 0.7 times the living minimum for an unsupported child. If a pension is granted, the substitute maintenance covers the difference between that 0.7 multiplier and the total pension amount.
