São Paulo court denies habeas corpus for lieutenant colonel accused of femicide

The Court of Justice of São Paulo has denied a new habeas corpus request filed by the defense of Military Police Lieutenant Colonel Geraldo Leite Rosa Neto. Neto is accused of the femicide of his wife, Soldier Gisele Alves Santana.

Defense attorneys argued that the preventive detention lacked adequate legal grounds and requested that the arrest be revoked or replaced with precautionary measures. They maintained that the defendant has a fixed residence, lawful occupation, and has cooperated with investigations, including participating in a simulated reproduction of the facts.

The court's decision, reported by Desembargador César Augusto Andrade de Castro, stated that no evident illegality was identified to justify immediate release. The ruling noted that the defense's arguments overlap with the merits of the case, which requires a more in-depth analysis beyond the scope of a preliminary injunction.

In addition to femicide, the officer faces accusations of procedural fraud, with investigations suggesting potential interference with the crime scene during the initial stages of the case.
