São Paulo zoning law faces judicial challenges and map invalidation

The São Paulo zoning law has become a complex patchwork of regulations following six legislative changes since 2022 and several judicial challenges. A recent decision by the São Paulo Court of Justice declared certain aspects of the current map unconstitutional, specifically targeting amendments that were deemed to have exceeded the original purpose of the law.

André Lemos Jorge, the municipal Secretary of Justice, clarified that the ruling does not invalidate the entire zoning revision. He stated that the court recognized the constitutionality of Municipal Law 18.081/2024, which included public participation and technical studies. However, the court found Article 8 of Law 18.177/2024 and the resulting Map 1 unconstitutional because the changes were viewed as extrapolating beyond the intended scope of making minor corrections.

The legal disputes involve various actors, including real estate developers, property owners, and neighborhood associations who claim to be negatively impacted by land classification changes. For example, the classification of certain areas as Environmental Protection Zones has halted specific construction projects. The municipal administration and the City Council have defended the legality of the changes, arguing that the amendments are legitimate legislative prerogatives.
