São Paulo zoning law judicial challenges

The São Paulo zoning law has entered a period of legal instability following judicial rulings regarding its recent revisions. A panel of 25 judges from the Court of Justice of São Paulo (TJ-SP) ruled the July 2024 revision unconstitutional, describing it as a “revision of the revision.” The court found that while the update aimed to correct mapping errors from the January 2024 law, legislators improperly included new areas for verticalization without required technical support.

This ruling specifically targets Article 8 of Law 18.177/2024 and its associated Map 1, though it does not invalidate the entire zoning framework. The court upheld the constitutionality of Municipal Law 18.081/2024, which included sufficient technical studies and public participation.

The legal disputes involve a variety of stakeholders, including real estate developers, property owners, and neighborhood associations. Some parties have seen construction projects halted due to land being reclassified as Environmental Protection Zones. While the municipal administration has defended the changes as legitimate legislative prerogatives, the court's decision effectively reinstates the regulations established in January 2024 for all new construction requests, though existing building permits and pending applications remain valid.
