Spain data center giants challenge new government regulations

Tech giants represented by the industry group Spain DC are preparing a legal challenge before the Council of State to block a Spanish government draft decree. The proposed regulation introduces new environmental and digital security requirements for new data centers in Spain.

Spain DC, which includes companies such as Amazon, Google, and Microsoft, argues that the government is attempting to use a royal decree—a regulatory instrument rather than a full law—to implement comprehensive sector regulation and a sanctioning regime that could revoke electricity grid access. The association also claims the measures lack proportionality, are discriminatory, and would apply retroactively to projects already in progress.

The legal strategy follows a critical report from the National Commission on Markets and Competition (CNMC). Spain DC is also seeking input from the European Commission to delay the regulation's approval, which the government aims to finalize before the November 29 elections.
