Spain launches consultation on data center regulations

The Spanish government has launched a public consultation for a draft Royal Decree to regulate data centers with an electrical capacity exceeding 1 megawatt. The proposed framework focuses on managing national grid impact, environmental protection, and digital sovereignty.

To ensure energy sustainability, the decree requires that at least 80% of a facility’s hourly energy consumption be met by new renewable energy sources. Specifically, operators must have installed one new megawatt of renewable capacity for every new megawatt consumed within the 18 months prior to commencing operations. The regulations also aim to align water and energy efficiency with EU indicators, such as Power Usage Effectiveness (PUE) and Water Usage Effectiveness (WUE).

Regarding digital sovereignty, the decree mandates that operators be established within the European Union and that all data, metadata, and operational records remain within EU territory. To enforce these standards, the government is considering significant financial penalties, including surcharges on electricity network access tolls for non-compliance.

Industry stakeholders, including the association SpainDC, have warned that while they support sustainability, the mandates must be technically viable and proportionate to avoid making Spain less competitive. They expressed concern that these rules might deter major international investments, noting that current grid access rights for data centers already significantly exceed the demand projected in Spain’s national AI strategy. Regional authorities, including the governments of Aragon and Madrid, have also criticized the short eight-day window for submitting allegations, citing “alarming legal uncertainty” that could jeopardize existing and planned investments.
