Spain data center industry warns of investment flight over new regulations

A regulatory conflict is emerging in Spain over the expansion of data centers. The Spanish government, through the Ministry for the Ecological Transition and the Demographic Challenge, has proposed a royal decree to regulate the sector's growth. The mandate requires new projects to ensure at least 80% of their energy consumption is covered by newly constructed renewable sources, alongside strict cybersecurity and digital sovereignty requirements.

The industry association SpainDC has responded with strong opposition, warning that the regulation could act as a de facto ban. They estimate that approximately 9,000 million euros in immediate investment—about 15% of the projected total through 2030—is at risk, as three international investors have already frozen projects. The association argues the rules are too restrictive compared to other European nations and could lead to a flight of capital to countries like France and Portugal.

In the region of Aragon, which has become a major European hub for digital infrastructure, the rapid deployment has drawn international attention and local scrutiny. While the government has utilized special administrative frameworks to attract investment, concerns persist regarding the environmental impact, specifically the high demand for electricity and water resources in a region facing climate challenges.
