Spain implements law restricting involuntary psychiatric admission
Article 13 bis of Law 4/2026 enters into force this Friday, restricting involuntary psychiatric hospitalization to cases of "vital urgency." This means patients can only be admitted against their will if their life is in imminent danger.
The Spanish Society of Psychiatry and Mental Health (SEPSM) has expressed concern, stating that without clear criteria and alternative resources, the law will leave many patients and their families without support.
A caregiver of a young man with uncontrolled paranoid schizophrenia shared a letter to institutions, arguing that the new regulation removes the only effective measure for managing severe psychotic breaks. She noted that under the new legal framework, previous necessary interventions could be classified as crimes against the liberty and dignity of the patient.
