Galician psychiatric involuntary admission law controversy

Overview

Psychiatrists in Galicia expressed concerns regarding Article 13 bis of Law 4/2026, a new regulation governing involuntary psychiatric admissions. Specialists warned that the law, which aims to strengthen the rights of people with disabilities, could prevent timely intervention for patients experiencing severe mental or physical deterioration, such as psychosis or anorexia.

José Ramón Silveira, president of the Galician Association of Psychiatry, noted that restricting admissions to “vital emergencies” creates difficulty in ensuring patient well-being.

Upon the law’s implementation on October 23, involuntary hospitalization became restricted to cases of “vital urgency” where a life is in imminent danger. The Spanish Society of Psychiatry and Mental Health (SEPSM) warned that a lack of clear criteria and alternative resources would leave many patients and families without support. Caregivers have also raised concerns that the new framework could reclassify previously necessary medical interventions as crimes against the liberty and dignity of the patient.
