Spain data center sector warns of investment risks amid new regulations
The Spanish government's proposed royal decree to regulate data centers has triggered widespread opposition from industry associations, regional governments, and major corporations. The draft legislation aims to ensure energy sustainability and digital sovereignty, notably requiring facilities to cover 80% of their hourly electricity consumption with new renewable generation.
SpainDC, representing over 300 companies, has filed formal allegations, warning that the cumulative restrictions could act as a de facto ban on the sector. The association estimates that between 80% and 90% of planned investments, totaling approximately 66.9 billion euros, are now at risk. Similarly, the regional government of Castilla y León expressed concerns that the rules are unfeasible for continuous operations and could jeopardize existing projects.
Major players including Microsoft, Merlin Properties, ACS, Acciona, and Ferrovial have also submitted allegations. These companies argue the decree was drafted without sufficient industry consultation and that the strict renewable energy requirements could make projects economically unviable. Meanwhile, Spanish industrial sectors have called for audits of data center costs to prevent potential electricity price hikes for households and traditional manufacturing.
