Spain: Proposals for Democratic Memory Archive and Supreme Court electoral ruling
Legal expert Catalina Moragues has proposed the creation of a Balearic Democratic Memory Archive to facilitate the conservation and consultation of historical heritage from the Spanish Civil War and Francoist dictatorship. The proposal, presented in Palma, suggests a dual-purpose institution: one branch to preserve documentation generated by regional memory laws from 2016 and 2018, and another to safeguard records from the 1936 coup and subsequent dictatorship. The proposed archive would include an audiovisual department for victim testimonies and a museum department for objects recovered during exhumations.
In a separate legal development, the Spanish Supreme Court has issued a precautionary suspension regarding certain electoral effects of registrations in the Census of Absent Residents. This decision follows the Democratic Memory Law, which allows citizens to acquire Spanish nationality. The court cited a ‘real and serious danger’ that an extraordinary increase in the census could impact the objectivity and transparency of future elections. This measure has sparked debate regarding judicial independence and the protection of fundamental suffrage rights.
