Spain data center decree sparks investor backlash and regional opposition
The Spanish government's proposed royal decree to regulate data centers has triggered intense opposition from industry groups, regional governments, and international investors. The draft regulation aims to enforce strict sustainability and digital sovereignty standards, most notably requiring that data centers back at least 80% of their electricity consumption with new renewable generation on an hourly basis.
The industry association SpainDC has labeled the decree a ‘de facto veto,’ warning that it could jeopardize up to €67 billion in projected investments. The association reports that three major international investors have already threatened to relocate €9 billion in projects to France or Portugal if the rules are implemented as written. Industry leaders argue the requirements are technically unachievable and create significant legal uncertainty.
Regional governments are also filing formal objections. Aragón warns that over €54 billion in technological investments are at risk, while Andalucía argues the decree is discriminatory, as its warmer climate makes meeting high energy and water efficiency standards more difficult and costly than in northern regions.
In response, the Spanish Ministry for Ecological Transition defended the measure, citing concerns over the massive electricity demand from data centers. Officials noted that in regions like Aragón and Madrid, granted access for data centers could double or triple local electricity consumption, potentially driving up prices and causing social and environmental tension similar to trends observed in the US and Ireland.
