Spain's Traffic Authority Issues Guidance on Vehicle Overnight Stays and EU Cross‑Border Fines

The Dirección General de Tráfico (DGT) clarified that drivers may spend the night inside a vehicle provided it is correctly parked, does not extend onto the road surface and no external equipment such as awnings, tables or chairs is deployed. The rule distinguishes between permissible overnight stays and prohibited camping, and notes that local ordinances may impose additional restrictions in protected natural areas, beaches or municipalities that expressly forbid sleeping in vehicles. Drivers are advised to check local regulations before staying overnight.

For traffic infractions incurred while driving in other European Union member states, the DGT explained that the responsibility lies entirely with the driver who was behind the wheel at the time of the offence. The fine must be dealt with directly by the national authority of the country where the violation occurred. Payment and appeal can be made through that country’s online portals or, where necessary, via the Spanish consulate. The DGT also pointed motorists to a European Commission platform that aggregates each state’s traffic regulations to help travelers prepare for cross‑border trips.
