Spanish Constitutional Court rejects Ombudsman appeal on ‘Grandchildren Law’

The Spanish Constitutional Court has rejected an appeal filed by the Ombudsman, Ángel Gabilondo, regarding the suspension of voting rights for citizens naturalized under the ‘Grandchildren Law’ (part of the 2022 Democratic Memory Law). The court dismissed the appeal by a 10-to-2 vote, deeming it premature because proceedings in the Supreme Court are still active.

The dispute centers on interim measures ordered by the Supreme Court to halt the registration of certain voters in the CERA census to ensure electoral purity. This affects more than 163,000 naturalized citizens who may be unable to vote in the upcoming general elections on November 29.

In response, the law firm ILOCAD, led by former judge Baltasar Garzón, has filed an exceptional incident of nullity before the Supreme Court. The firm argues that the suspension of voting rights violates fundamental rights to political participation and equality, asserting that mass deprivation of suffrage is unconstitutional.

Additionally, the Supreme Court has granted ministers Félix Bolaños and José Manuel Albares a deadline to provide a nominal list of the affected individuals. Failure to comply with judicial deadlines could result in fines or criminal liability for the officials.
