Spain Constitutional Court to review Ombudsman appeal on voting rights

The Spanish Constitutional Court is set to deliberate on an appeal filed by Ombudsman Ángel Gabilondo regarding the suspension of voting rights for approximately 163,020 citizens naturalized under the 'grandchildren law' (Ley de Memoria Democrática).

The Supreme Court previously issued precautionary measures suspending the right to vote for these individuals in the upcoming general elections scheduled for November 29. The Ombudsman’s appeal seeks to overturn this suspension, arguing that it threatens fundamental rights.

There is significant judicial debate regarding whether the appeal is premature. Legal experts and some magistrates suggest that because the ordinary judicial process in the Supreme Court is still ongoing, the Constitutional Court should not intervene until a final ruling is reached. The People's Party (PP) has also announced its intention to intervene in the proceedings to protect the integrity of the electoral roll.
