Spanish court requires individual proof for AP-9 toll refund claims

A judge of the Pontevedra Commercial Court ruled that drivers who were overcharged on the AP-9 highway between February 2015 and June 2018 must file a separate declaratory request and provide evidence of their trips before the court can enforce the Supreme Court‑backed judgment against toll operator Audasa. The decision obliges each claimant to prove consumer status, travel on the 81 affected segments of the bridge of Rande during the specified dates and time slots, and the exact amounts paid.

The court rejected the execution request filed by the consumer group En Colectivo, which claimed to act on behalf of 14 members, because the group had not supplied the required data and the individuals named did not match those previously involved in the case. Consequently, no executive title exists yet, and the ruling can be appealed to the Audiencia Provincial of Pontevedra.
