Spain Supreme Court suspends voting rights for 'Grandchildren Law' beneficiaries
The Spanish Supreme Court has issued a precautionary ruling to suspend the electoral effects of the Democratic Memory Law, commonly known as the 'Grandchildren Law.' This decision follows appeals by the political parties Vox and Iustitia Europa, who argue that the law's application could compromise the transparency and objectivity of future elections.
The ruling specifically targets an administrative instruction from the Ministry of Justice that had expanded the law's scope. While the original law allowed descendants of Spanish exiles to claim nationality, the instruction created a general presumption of exile for those who left Spain between 1936 and 1955, allowing for naturalization without individual proof of political or ideological exile. The court has ordered that the immediate registration of these new citizens in the Census of Absent Residents (CERA) be frozen, and for those already registered, their voting rights for future elections are suspended pending a final verdict.
Prime Minister Pedro Sánchez has criticized the decision and the opposition parties, accusing them of attempting to restrict the rights of thousands of citizens and questioning the democratic system. Conversely, critics and opposition leaders argue the government used the law to artificially expand the electoral roll for political advantage. The court has instructed the central electoral commission to distinguish between different types of registrations to ensure that those who can prove direct exile requirements are not unfairly disenfranchised.
