Supreme Court of Pakistan rules Haq Mahr is a mandatory legal right
The Supreme Court of Pakistan has ruled that dower (Haq Mahr) is a mandatory legal right of a wife under Islamic law and not a favor or charity bestowed by a husband. A four-member bench, led by Justice Shahid Waheed, emphasized that dower constitutes the wife’s exclusive proprietary right and is protected by constitutional values of human dignity and equality.
The court clarified that a Nikahnama serves as official evidence of marriage terms and that dower cannot be conditioned upon a wife’s behavior or her decision to seek a divorce, as such conditions amount to coercion. The ruling stated that if a husband fails to pay the agreed dower, courts must intervene with full legal authority.
In cases where immovable property was stipulated as dower but not transferred, the husband remains liable to pay the agreed value of that property. If no specific value was fixed, courts may determine the market value at the time of the claim. The judgment aims to ensure that marriage does not become a transaction where a woman's rights are treated as an afterthought.
