Pakistan Supreme Court rulings on women's rights

Overview

The Supreme Court of Pakistan issued a ruling clarifying that dower (Haq Mahr) is a mandatory legal right for a wife under Islamic law, rather than a favor or charity from a husband.

A four-member bench, led by Justice Shahid Waheed, emphasized that dower is an exclusive proprietary right protected by constitutional values of equality and human dignity. The court ruled that dower cannot be conditioned on a wife’s behavior or her decision to divorce, as such conditions constitute coercion.

Furthermore, the court established that if a husband fails to pay the agreed dower, legal authorities must intervene. In instances where immovable property was promised but not transferred, the husband is liable for the property's value, which courts may determine based on current market rates if no specific value was previously fixed.
