Supreme Courts issue landmark rulings on euthanasia, procurement and drug case

The Spanish Supreme Court (Tribunal Supremo) is hearing a first‑of‑its‑kind case on whether a parent can block a euthanasia request. The dispute centres on 55‑year‑old Francesc Augé of Vallirana, whose 95‑year‑old father opposes his wish to die, a matter that will set precedent on the legal standing of close relatives in assisted‑death decisions. The prosecutor has argued that an “intense emotional bond” may justify intervention, while the defence stresses the individual's autonomous right to a dignified death.

In Chile, the Supreme Court (Corte Suprema) annulled the conviction of Rodrigo Patricio Severino Velasco for alleged marijuana trafficking in Quilpué. The Court identified a legal error in the lower‑court’s dismissal of evidence that the cannabis was intended for personal medicinal use by the defendant and his mother, leading to his acquittal.

Separately, Spain’s Supreme Court administrative chamber issued a May 2026 decision (rec. 2814/2024) that clarifies two legal points: contractors performing work without a contract are entitled to market‑based compensation rather than contract‑based pricing, and courts must provide a substantive justification when deeming evidence “useless” before rejecting it. The ruling reinforces doctrines on unjust enrichment and evidentiary standards.
