Sweden proposes new crime of participating in criminal gangs

The Swedish government has issued a legislative referral proposing the introduction of a new crime: participation in a criminal association. This measure aims to combat organized crime, which Justice Minister Gunnar Strömmer described as a serious threat to both individuals and society.

The proposal seeks to expand the scope of criminal liability for those connected to criminal networks. It includes specific criminal responsibility for individuals who exercise control or leadership over a criminal association, as well as those who take actions to promote, strengthen, or support the group's illegal activities.

Penalties for participation include up to four years in prison. For aggravated participation, sentences range from two to eight years. Those found to be leading a criminal association could face prison terms ranging from two to eighteen years, or life imprisonment. Additionally, the proposal suggests that secret coercive measures may be used during investigations, even if the suspect is under the age of 15.
