Swedish legislative proposals against gang participation

The Swedish government is advancing legislative efforts to criminalize participation in criminal gangs to combat organized crime. Initial proposals indicated that a constitutional amendment would be necessary to implement these measures. Under early frameworks, standard participation could carry up to four years in prison, while gang leaders could face life imprisonment. While the Social Democrats and the Left Party supported the required constitutional changes, the Center Party and the Green Party expressed opposition.

Following these developments, the government issued a formal legislative referral for the new crime of ‘participation in a criminal association’. Justice Minister Gunnar Strömmer characterized organized crime as a “serious threat to both individuals and society”.

The refined proposal expands criminal liability to include those who exercise control or leadership, as well as those who act to promote, strengthen, or support a group’s illegal activities. Penalties have been specified as follows: up to four years for participation, two to eight years for aggravated participation, and two to eighteen years or life imprisonment for those leading an association. The proposal also suggests that secret coercive measures may be utilized during investigations even for suspects under the age of 15.
