Texas federal court strikes down parts of National Firearms Act
A federal judge in the Northern District of Texas has ruled that certain registration requirements of the National Firearms Act (NFA) are unconstitutional. In the case of Silencer Shop Foundation v. Bureau of ATF, U.S. District Judge James Wesley Hendrix determined that because the One Big Beautiful Bill Act repealed the taxes for certain firearms, the registration requirements no longer have a constitutional basis under Congress's power to lay and collect taxes.
The ruling specifically affects suppressors, short-barreled rifles, short-barreled shotguns, and 'any other weapons.' However, the decision is limited to members of Gun Owners of America and other named plaintiffs rather than being a nationwide injunction. Machineguns and destructive devices were not included in the ruling and remain subject to a $200 tax.
