Thailand implements new deportation rules for foreign nationals

Thailand has implemented new deportation regulations, effective August 28, 2026, aimed at accelerating the removal of foreign nationals who violate laws or threaten public order. The Prime Minister’s Office Regulation on Deportation B.E. 2569 was signed by Prime Minister Anutin Charnvirakul and published in the Royal Gazette on August 27.

The rules target individuals involved in illegal entry, unauthorized work, illegal business operations, and the forgery of official documents. Foreigners convicted of crimes carrying a prison sentence of five years or more, as well as those who instigate or support such offenses, are also subject to deportation. The regulation grants the Interior Minister authority to order deportations for behavior deemed contrary to public order, morality, or public welfare.

To streamline the process, correctional authorities are required to notify the Interior Ministry of qualifying foreign inmates at least 15 days prior to their release. While the policy generally mandates return to a person's country of nationality, provisions are included for transfers to safe third countries in cases where deportees face risks of torture or inhumane treatment in their home nations. The government maintains that it continues to welcome law-abiding foreigners for tourism, business, and residency.
