TikTok fined BRL 153.7 million by Brazil's ANPD over minor data privacy
The Brazilian National Data Protection Authority (ANPD) has imposed a BRL 153.7 million fine on TikTok, the largest sanction ever levied against a big tech company in Brazil. The penalty follows investigations revealing that TikTok, controlled by ByteDance, failed to implement adequate age verification for users under 18 and processed the personal data of adolescents without a valid legal basis, violating the General Data Protection Law (LGPD).
In addition to the TikTok ruling, Brazilian authorities are increasing scrutiny on other platforms. The Federal Public Ministry (MPF) has opened proceedings to monitor Discord's safety measures for children and adolescents following concerns raised by the ANPD regarding the platform's ability to protect minors within private communities.
ANPD President Waldemar Gonçalves stated that while the agency is increasing its enforcement and presence to ensure compliance with the LGPD and the Digital Child and Adolescent Statute, there will not be an uncontrolled explosion of new sanctions. He emphasized that the agency's focus is on creating a safe digital environment for young users rather than simply restricting access.
