In the United States, TikTok reached a $400 million settlement with the Department of Justice to resolve allegations of violating federal children’s privacy laws. The agreement involves a $300 million immediate payment, with the remaining $100 million contingent upon a judicial decision regarding a 2019 consent decree. U.S. Associate Attorney General Stanley E. Woodward Jr. described the resolution as a “major victory for American children and parents.”
Concurrently, Brazil’s National Data Protection Authority (ANPD) imposed a fine of R$ 153.7 million on the platform, marking the largest sanction against a big tech company in the country. The ANPD determined that TikTok failed to implement adequate age verification for users under 18 and processed adolescent data without a valid legal basis under the General Data Protection Law (LGPD).
Following this ruling, Brazilian authorities have increased scrutiny on other platforms. The Federal Public Ministry (MPF) has opened proceedings to monitor safety measures on Discord regarding the protection of minors within private communities. ANPD President Waldemar Gonçalves stated that while the agency is increasing enforcement to ensure compliance with the LGPD and the Digital Child and Adolescent Statute, the focus is on “creating a safe digital environment for young users rather than simply restricting access.”
