The ECI has held separate meetings with both delegations, requesting additional documentation and clarifications. The Mamata Banerjee-led faction maintains there is no dispute over the party's organizational structure, while the Ritabrata Banerjee-led group, which includes approximately 60 of the 80 newly elected TMC MLAs, claims to be the legitimate leadership.

This legal battle occurs ahead of critical assembly bypolls in the Nandigram and Rejinagar constituencies, scheduled for October 6. The Ritabrata Banerjee faction has stated they will withdraw their candidate in Nandigram if Mamata Banerjee decides to contest the seat, expressing a desire to see her return to the Assembly. The deadline for filing nominations for these bypolls is September 16, creating significant uncertainty regarding which faction will be permitted to use the official TMC name and symbol.
