Trump fails to file Supreme Court rehearing petition on birthright citizenship

President Donald Trump promised on Truth Social to request an immediate rehearing by the United States Supreme Court after the Court’s June 30 ruling that rejected his proposal to limit birthright citizenship. The ruling, a 6‑3 decision, upheld the 14th Amendment’s citizenship clause, confirming that anyone born in the United States is a citizen regardless of parental status.

The 25‑day deadline for filing a petition for rehearing closed on Monday, and the Court’s docket shows no petition was submitted. Legal experts note that a rehearing petition is rarely granted and would require support from at least one justice in the majority. The last such petition was granted in 1965. Despite the missed deadline, Trump continues to claim widespread “birth tourism” and has called the Court’s decision a miscarriage of justice.
