Turkey outlines legal process for PKK member surrender

Following the parliamentary approval of a framework law aimed at achieving a 'terror-free Turkey,' the legal procedures for the potential surrender and release of approximately 3,800 PKK members have been outlined. To manage the judicial workload, the process will be divided into three distinct categories.

First, convicted prisoners with finalized sentences for crimes such as membership in a terrorist organization, propaganda, or financing terrorism—provided they were not involved in armed attacks—will have their files handled by local enforcement judges. Their sentences may be suspended and recalculated under the new law to allow for release.

Second, detainees whose trials are still ongoing will be processed by heavy penal courts. These courts will evaluate the cases under the new framework to decide on the suspension of enforcement or release. For cases currently at the regional appeal or Supreme Court level, the higher courts will apply the new law directly to finalize the cases without sending them back to local courts.

Third, fugitives with active arrest warrants, including those in mountain cadres or abroad, will be handled by public prosecutors. For those without existing convictions, prosecutors will prepare indictments following the surrender and statement process, which may lead to new legal proceedings.
