Turkish Court Halts Implementation of Zoning Plan Changes in Kayseri
The Kayseri 2nd Administrative Court has issued a stay of execution regarding a zoning plan amendment in the Melikgazi district of Kayseri, Turkey. The lawsuit was filed by Mustafa Çalıksoy, a member of the YENİ Party Assembly.
The plaintiff challenged the 1/1000 scale implementation zoning plan changes approved by the Melikgazi Municipality and subsequently the Kayseri Metropolitan Municipality. The legal challenge argues that the changes, which affect specific parcels in the Erenköy neighborhood, were not driven by necessity or public need but were instead made to satisfy the financial expectations of property owners. Furthermore, the plaintiff claims the new planning fails to provide sufficient green spaces or municipal service areas, making it unlawful.
In response, the Kayseri Metropolitan Municipality defended the decision, stating that the implementation plan aligns with previous master zoning plan amendments. The municipality maintains that the changes account for a population increase of 23 people within the approval limits, resulting in increased green spaces without disrupting urban transportation systems or social infrastructure balance.
