Turkish zoning plan legal challenges

Overview

Legal disputes have emerged regarding municipal and presidential zoning plan amendments in different regions of Turkey.

In Bodrum, the Union of Chambers of Turkish Engineers and Architects (TMMOB) filed a lawsuit to annul new zoning plans for the Ortakent neighborhood. TMMOB argues that the plans, approved by a Presidential decision, ignore previous Council of State rulings that found such developments would cause significant environmental damage. The union contests the classification of protected natural spaces as “idle” to facilitate construction.

In Kayseri, the 2nd Administrative Court issued a stay of execution regarding implementation zoning plan changes in the Melikgazi district. The legal challenge, filed by a member of the YENİ Party Assembly, alleges the changes were made to satisfy property owners' financial interests rather than public need, and that they fail to provide adequate green spaces. The Kayseri Metropolitan Municipality defended the amendments, stating they align with master plans and account for local population increases.
