Yargıtay rules on vehicle defects and MMO issues import safety warning
The Turkish Court of Cassation (Yargıtay) has issued a landmark ruling regarding consumer rights in the automotive sector. The 3rd Civil Chamber upheld a decision requiring a car manufacturer to replace a new vehicle with an identical, defect-free model after a consumer discovered paint bubbling on the roof. The court classified the manufacturing flaw as a ‘hidden defect’ (gizli ayıp), ruling that consumers cannot be forced to use a vehicle that does not meet expected quality standards.
Separately, the Chamber of Mechanical Engineers (MMO) has issued a safety warning regarding the potential import of approximately 5,000 used vehicles, aged 15 to 20 years, currently held in ports in Northern Cyprus. The MMO warned that these vehicles may carry significant safety risks, specifically citing the Takata airbag issue. The organization urged citizens to verify a vehicle’s identity, manufacturer recalls, and damage history before purchasing used imports, threatening legal action if mass import permits are granted without adequate safety oversight.
