Turkish judicial rulings on automotive consumer rights

Overview

The Turkish Court of Cassation (Yargıtay) has issued several rulings clarifying consumer protections within the automotive sector. In one landmark decision, the 3rd Civil Chamber upheld a requirement for a manufacturer to replace a new vehicle with an identical, defect-free model after paint bubbling was identified as a ‘hidden defect’ (gizli ayıp).

In a separate matter regarding administrative and data disputes, the Court of Cassation ruled that consumer courts hold jurisdiction over cases involving erroneous vehicle damage records. This follows a dispute where an owner sought to rectify incorrect accident data within the Insurance Fraud Information Sharing System (SİSBİS). The court determined that because insurance companies act as service providers, such disputes fall under Law No. 6502 on the Protection of Consumers.
