The court's decision relied heavily on the sworn testimony of Sultan Nur Ulu, the sole eyewitness present at the scene. Ulu testified that while she was looking in a mirror, she saw Gülter grab her mother from behind by the upper thigh and throw her out of the window. Although Ulu's initial statements differed, the court accepted her updated testimony, noting she had previously been too afraid of the defendant to tell the truth.

Evidence reviewed included apartment security camera footage, which confirmed that no one else entered or exited the residence during the timeframe of the incident. Additionally, criminal laboratory reports indicated no traces of slippery substances on the floor near the window, contradicting defense claims of a slippery surface. While the court found the killing intentional, it ruled that the evidence did not sufficiently prove premeditation.
