UK government launches consultation to boost rights for cohabiting couples

The UK government has published a consultation on family law reforms aimed at strengthening financial protections for unmarried partners. Proposals include automatic inheritance rights for cohabitants whose partner dies intestate, greater consideration of domestic abuse when dividing finances, and making pre‑ and post‑nuptial agreements legally binding. Couples would be recognised as cohabitants after three years of living together or if they share a child.

Justice Secretary David Lammy said the changes are intended to give “support and certainty” to vulnerable people during break‑ups, especially amid cost‑of‑living pressures. Legal professionals welcomed the move, noting that the current law leaves many cohabiting partners without recourse and can allow abuse to persist after separation. The consultation closes on 14 August.
