UK inheritance tax reform and pension tax impact
Overview
HMRC guidance remains that from 6 April 2027, most private and workplace pension savings and death benefits will be treated as part of an estate for inheritance tax (IHT) purposes. To mitigate this, the incoming Burnham administration will implement a £3,000 annual gifting allowance and a “surplus income” provision for tax-free gifts. While the nil-rate band remains at £325,000 and the residence nil-rate band at £500,000, married couples can still shield up to £1 million through transferred allowances. Recent data highlights increasing fiscal drag. Estates worth over £1 million left without a will rose from 332 in 2023 to 781 last year, contributing to a rise in total intestate estates to over 43,000. In the 2023/24 period, 4.72% of UK deaths triggered an IHT charge—the highest share since 2006/07—affecting 30,400 estates with an average bill of £231,000. Total tax receipts reached £7 billion and are projected to hit £14.7 billion by 2030/31. The standard IHT threshold has remained at £325,000 since 2009 and is scheduled to stay at that level until April 2031, pulling more middle-income estates into the tax bracket as property values rise. Financial advisors warn of severe tax implications for pension beneficiaries. Claritas Tax estimates that wealthy individuals could face a combined tax rate of up to 67% when 40% IHT is applied to pension values followed by income tax. NFU Mutual has warned of a potential hit of up to 91% for beneficiaries inheriting from savers who die after age 75. Further reforms effective April 2026 have introduced a £2.5 million cap on 100% relief for agricultural and business property; values exceeding this qualify for only 50% relief. In response to the 2027 pension changes, some individuals are exploring relocation to countries with more favorable regimes, such as Australia, New Zealand, or Singapore.
