United Kingdom implements new trade union access rights
New legislation under the Employment Rights Act has granted independent trade unions in England, Scotland, and Wales a statutory right to request physical or digital access to workers. Under these rules, unions may approach staff in person or through electronic communication to organize and support members.
If an employer and a union cannot reach a voluntary agreement regarding workplace access, the Central Arbitration Committee will oversee a formal dispute resolution process. Businesses employing fewer than 21 people are exempt from these specific access requirements.
Additionally, starting in January, employers will be legally required to inform workers of their right to join a union. TUC General Secretary Paul Nowak has predicted that these changes, alongside existing frameworks, could trigger a wave of new union recognition deals between employers and unions over the coming year.
