UK Employment Rights Act 2025 implementation
Overview
The implementation of the Employment Rights Act 2025 in the United Kingdom has introduced new statutory rights for trade unions. Under the legislation, independent unions gain the right to request workplace access for purposes such as recruiting, organizing, and facilitating collective bargaining. While the Central Arbitration Committee may order access if an employer refuses a request, the law stipulates that such access must not “unreasonably interfere with the employer’s business operations.”
As of October 30, 2026, the new legislation is officially in effect across England, Scotland, and Wales. Independent trade unions now hold a statutory right to request both physical and digital access to workers to organize and support members. If voluntary agreements cannot be reached, the Central Arbitration Committee will oversee a formal dispute resolution process. Notably, businesses employing fewer than 21 people are exempt from these specific access requirements.
Looking ahead, employers will be legally required to inform workers of their right to join a union starting in January. TUC General Secretary Paul Nowak has predicted that these changes, combined with existing frameworks, could trigger a wave of new union recognition deals between employers and unions over the coming year.
