US Appeals Court rejects Trump administration request to suspend TPS for Venezuelans
The Ninth Circuit Court of Appeals in California has rejected a request from the Donald Trump administration to maintain the suspension of Temporary Protected Status (TPS) for Venezuelan nationals. This ruling means that, unless the Supreme Court intervenes, TPS is set to be reinstated on November 6, 2026.
The legal battle stems from a previous decision that found the Department of Homeland Security's termination of the program to be illegal. Specifically, the court concluded that the former Secretary of Homeland Security exceeded legal authority when ending the measure.
If the Supreme Court does not act to extend the suspension before the deadline, the ruling will automatically restore protection against deportation and validate work permits for hundreds of thousands of Venezuelan migrants. While the decision is a significant step for beneficiaries, it does not constitute a final ruling on the merits of the case, as litigation regarding the termination of the benefit continues.
