US legal dispute over Venezuelan TPS status

Overview

Legal proceedings regarding the Temporary Protected Status (TPS) for approximately 600,000 Venezuelans have continued in US federal courts. In October 2026, attorneys for the National TPS Alliance and Venezuelan TPS holders petitioned a federal appeals court to reinstate a 2025 district court ruling. This ruling had previously found that the attempt to strip Venezuelans of TPS violated the Administrative Procedure Act.

The legal challenge followed a Supreme Court stay issued in October 2025, which had halted the lower court decision. While the US government sought to extend the suspension of protections, the Ninth Circuit Court of Appeals rejected the Trump administration’s request to maintain the suspension in November 2026.

Unless the Supreme Court intervenes, the ruling sets the reinstatement of TPS for November 6, 2026. If the stay is not extended, the decision would restore protection against deportation and validate work permits for the affected population. Litigation regarding the termination of the benefit remains ongoing.
