US Appeals Court Temporarily Halts Ruling Against Trump’s 10% Import Tariffs

A US Court of Appeals has suspended the decision of the International Trade Court that had found President Donald Trump’s temporary 10% tariffs on most imports unlawful. The suspension means importers must continue paying the 10% duties while the appellate judges review the administration’s request for relief.

The original ruling, issued by the International Trade Court in New York, held that Trump exceeded his authority by invoking a 1974 trade statute to impose the tariffs, which were first applied on 24 February 2026 after the Supreme Court invalidated earlier measures. Plaintiffs, including the state of Washington and two companies, have seven days to respond to the appeal. The administration argued that overturning the tariffs would damage its trade agenda, destabilize efforts to address the trade deficit, and risk loss of revenues already collected. Depending on the appellate outcome, the case could proceed to the Supreme Court.
