U.S. appeals court upholds Trump's 10% global tariff

A U.S. federal appeals court has extended a suspension of a lower‑court order that had declared the 10% global tariff illegal, allowing the levy to remain in effect while the legal dispute proceeds. The tariff, imposed in February under Section 122 of the 1974 Trade Act after the Supreme Court struck down most of former President Donald Trump’s other tariffs, is set to expire at the end of July unless Congress extends it. The administration is also preparing longer‑term tariff measures to replace the temporary rate.

The court found that the government had shown a likelihood of success on the merits and met the legal criteria for keeping the suspension, meaning importers, including small businesses and the state of Washington, will continue to pay the tariff during the ongoing litigation.
