United States announces visa restrictions on birth tourism facilitators

U.S. Secretary of State Marco Rubio has announced new visa restrictions aimed at curbing commercial birth tourism. The policy, implemented under Section 212(a)(3)(C) of the Immigration and Nationality Act, targets individuals who knowingly engage in, have engaged in, or facilitate the practice of traveling to the United States primarily to give birth for the purpose of securing American citizenship for their children.

The restrictions specifically target owners, operators, and managers of commercial birth tourism networks, visa “fixers” who coach applicants to commit fraud, and foreign medical providers who knowingly facilitate such travel or the fraudulent use of Medicaid. Certain family members of those covered by the restrictions may also be affected.

In conjunction with these measures, the State Department has launched a new online portal to allow the public to report suspected visa fraud and misuse. The portal accepts information regarding various immigration categories, including tourist, student, and employment visas, and allows for anonymous submissions. The department stated that the initiative is intended to protect the integrity of the U.S. immigration system, safeguard public benefits, and enhance national security.
