Sen. Jim Banks Introduces Bill to End Birthright Citizenship for Anchor Babies

The U.S. Supreme Court issued a 5‑4 ruling that struck down President Trump’s executive order aimed at ending birthright citizenship for children of undocumented immigrants and birth tourists. In the concurring opinion, Justice Brett Kavanaugh noted that Congress could amend the immigration statutes to create exceptions.

Republican Senator Jim Banks of Indiana responded by introducing the Citizenship Act of 2026. The bill would amend the Immigration and Nationality Act to label anyone who enters the United States without authorization or for the purpose of birth tourism as an “invader,” thereby excluding their U.S.-born children from automatic citizenship. Banks argues the legislation is needed to protect American sovereignty and to curb what he describes as an “invasion” of illegal aliens. He cites an estimate of about 250,000 anchor‑baby births each year.

The proposal follows related actions in Texas, where Governor Greg Abbott ordered investigations into hospitals allegedly promoting birth‑tourism services. While the Texas measures target health‑care providers, the core federal effort remains Banks’ bill, which seeks to codify the Trump administration’s policy through Congress rather than a constitutional amendment.
