US Senate rejects Ratepayer Protection Act targeting data center energy costs
The United States Senate failed to advance the Ratepayer Protection Act on Wednesday, September 30, 2026, in a 57-43 vote. The legislation, which had previously passed the House of Representatives with a 417-3 vote, aimed to require state utility regulators to consider standards that would force large electricity users, such as artificial intelligence data centers, to cover the costs of the infrastructure and grid upgrades required to serve them.
The bill fell short of the 60-vote threshold required to overcome a Senate filibuster. While proponents, including Republican Senator Jon Husted, argued the measure would protect households from rising energy costs driven by the AI boom, many Democrats opposed it. Senate Minority Leader Chuck Schumer and other Democrats characterized the bill as a “toothless messaging bill” that lacked mandatory enforcement mechanisms, arguing it only suggested rather than required states to take action.
In response, Senator Martin Heinrich introduced the GRID Savings Act of 2026, a competing proposal that would mandate, rather than merely suggest, that large electricity users pay for the facilities needed to connect them to the grid. The failure of the bill occurs amidst growing concerns over the energy demands of data centers, which are projected to significantly increase U.S. peak-summer electricity demand by 2027.
