US State Department warns of wrongful detention risk in China

The U.S. State Department has updated its travel advisory for mainland China, maintaining a Level 2 “Exercise Increased Caution” status while adding a “D” risk indicator for wrongful detention. Officials warned that Americans face a serious risk of being detained without a fair legal process, noting that Chinese authorities may enforce local laws arbitrarily or impose exit bans.

The advisory highlights that routine professional, academic, or personal activities could be treated as criminal offenses under China's broad security laws. Furthermore, the department warned of extensive electronic surveillance, advising travelers to assume that private communications, including emails, texts, and social media activity, may be monitored by Chinese security services.

Specific groups identified as facing heightened risks include Americans of Chinese descent, individuals involved in business disputes, and those with ties to U.S. law enforcement, the military, intelligence agencies, or the federal government. The State Department has formally designated two U.S. citizens, seismologist Chen Youlin and scholar Min Zin, as wrongfully detained.
