US wrongful detention warnings for China

Overview

The U.S. Department of State has expanded its wrongful detention warnings to include mainland China, placing it alongside Russia and Eritrea as nations where American citizens face a serious risk of arbitrary arrest. In China, officials cited the “arbitrary enforcement of local laws, the use of exit bans without a fair and transparent process under the law, and the risk of wrongful detention.” The advisory follows the cases of American scholar Min Zin and seismologist Youlin Chen, both of whom have faced espionage charges contested by their families.

Subsequent updates to the travel advisory maintained a Level 2 “Exercise Increased Caution” status but added a “D” risk indicator for wrongful detention. The State Department warned that routine professional, academic, or personal activities could be treated as criminal offenses under broad security laws.

Heightened risks were identified for Americans of Chinese descent, individuals in business disputes, and those with ties to the U.S. military, intelligence agencies, or federal government. Additionally, the department warned of extensive electronic surveillance, advising travelers that private communications may be monitored by security services.
