New York implements AI safety regulations and registration

New York Governor Kathy Hochul has announced the next steps for implementing the Responsible AI Safety and Education (RAISE) Act, a legislative package designed to regulate large-scale artificial intelligence developers. Starting in November, frontier AI companies with annual revenues exceeding $500 million must register with the state.

Under the new regulations, companies will be required to report critical safety incidents—defined as events involving potential catastrophic risks such as death, serious injury to 50 or more people, or damages exceeding $1 billion—to the state’s newly created Office of Digital Innovation, Governance, Integrity and Trust (DIGIT) within 72 hours. Full compliance and enforcement are set to begin on January 1, 2027.

Hochul also noted that the state is exploring additional safeguards, including the potential implementation of “AI kill switches” to shut down systems if they are deemed to be acting in a way that threatens public safety. Marc Gilman, a technology attorney and compliance expert, has been appointed as the deputy director of the DIGIT office to oversee the rollout of these requirements.
