US Supreme Court blocks Trump tariffs, spurring $166 bn refund process for importers

The US Supreme Court issued a 6‑3 decision that the International Emergency Economic Powers Act does not give the president authority to impose tariffs, effectively overturning President Trump’s worldwide import taxes. The ruling opened a claims period for importers to seek refunds of duties paid under the now‑invalid tariffs.

Importers are eligible for refunds totaling roughly $166 billion, with about $95 billion already moving through the system. Small businesses, such as Busy Baby’s founder Beth Benike, are awaiting refunds of around $50,000. Benike said, “If you know the steps and know the resources, the free resources, it’s very simple,” but added, “And now the process of waiting is where the uncertainty comes in.” Customs officials say early filers are given priority, and while refunds will aid businesses, they will not fully recoup losses incurred during the tariff period.
